When booking a tour with us at Evergreen winery tours. Clients must agree with these terms and conditions for which we By confirming your booking with Evergreen Winery Tours, you agree to the Terms and Conditions outlined below. These policies allow us to maintain our high standard of service for every tour.


General Cancellation Policy

We understand that plans can change. To manage our fleet and staffing effectively, the following policy applies to all bookings:

7+ Days Before Tour: A full refund of the balance is available for cancellations made more than 7 days prior to your scheduled tour date. Note: All deposits are 100% non-refundable and will be retained.

3 to 7 Days Before Tour: Cancellations made between 7 days and 72 hours (3 days) before the tour date are eligible for a 50% refund of the remaining balance.

Within 48 Hours: No refunds will be issued for cancellations made within 48 hours of the tour start time.

Tour Start Time: For the purposes of this policy, all tour start times are scheduled for 9:30 am.

Note on Deposits: All $200 deposits are strictly non-refundable. If a client cancels a tour at any time, the deposit portion of the payment is forfeited.

Extra Info

  • Evergreen winery tours have the right to cancel any tours due to extreme weather warnings. refunds will be issued or dates moved to suit with discussion.
  • With tour pricing quoted please be aware this price is only accurate for amount of people quoted. If you increase or decrease group size, we will requote the tour price.
  • No alcohol consumption onboard vehicles.
  • We reserve the right to end the tour at any time if groups are over intoxicated or we deem patrons to breach RSA at venues.

Cleaning/Damage Fees

  • If any of our vehicles/property or charters are left in an excessively dirty state or there is any illness on board. The organiser or organisation will be charged a minimum of $300 for deep cleaning. Any damage caused by guests will also be charged as per quote to fix.

For Helicopter Booked Tours

  • No refunds within 8 days of the tour.
  • Helicopter cost refundable or reschedule if helicopter company cancels due to weather on the day.
  • For tour on ground transport component policy refer to the general refund policy listed above.

For Hot Air Balloon Booked Tours

  • No refunds within 5 days of the tour
  • Hot air balloon cost refundable or rescheduled if the hot air balloon company cancels due to weather on the day.
  • For tour component policy refer to the general refund policy listed above.

3. Third-Party Activities (Helicopter & Hot Air Balloon Flights)

3.1 Independent Providers

As part of our premium wine tour itineraries, we may facilitate bookings for optional adventure activities—including but not limited to helicopter flights and hot air balloon rides. You acknowledge and agree that these aerial activities are not owned, operated, managed, or controlled by Evergreen Winery Tours (hereafter referred to as “the Company”). They are operated entirely by independent, licensed third-party service providers (“Third-Party Operators”).

3.2 Safety and Service Responsibility

  • Operator Liability: The Third-Party Operator is solely responsible for the safe operation of the aircraft, adherence to aviation regulations, and the overall quality of the service provided.
  • Assumption of Risk: Aviation activities carry inherent risks. By booking these activities, you agree to comply with all safety briefings, weight restrictions, and health requirements mandated by the Third-Party Operator.
  • Waivers: You may be required to sign a separate liability waiver directly with the Third-Party Operator before boarding. Refusal to sign will result in forfeiture of the activity without a refund from the Company.

3.3 Limitation of Liability

To the maximum extent permitted by law, the Company, its directors, and employees accept no liability for any injury, loss, damage, accident, delay, or irregularity caused by the acts, omissions, or negligence of any Third-Party Operator or their equipment.

3.4 Weather, Cancellations, and Schedule Changes

  • Weather Dependability: Both helicopter and hot air balloon flights are strictly subject to weather conditions and pilot discretion.
  • Cancellations: If a Third-Party Operator cancels a flight due to safety or weather, the Company will attempt to rebook the activity or pivot your itinerary to a land-based alternative (e.g., additional winery tastings).
  • Refunds: Refunds for cancelled third-party activities are subject entirely to the specific cancellation policy of that Third-Party Operator. The Company is not responsible for refunding any non-refundable deposits required by the operator.
